These Terms and Conditions ("Agreement") govern the rental of event equipment, including German Domes, Hanger Tents, and associated structures and services ("Equipment"), from FBH Events Management ("The Company," "we," "us," or "our") to the Renter ("you" or "the client"). By confirming an order or accepting a quote, you agree to be bound by these terms.
1. Rental Period and Payments
- Rental Period: The rental period is defined in the confirmed quotation and includes installation, usage, and dismantling time. Early access or late removal must be agreed upon in writing.
- Booking Deposit: A non-refundable deposit (specified in the quote) is required to confirm and secure the booking date(s).
- Final Payment: The remaining balance is due in full prior to the commencement of the installation work, unless explicitly agreed upon for institutional or corporate clients.
- Pricing: All pricing is subject to final confirmation upon signing the formal rental agreement and is based on the provided specifications (location, size, duration).
2. Cancellation and Termination
The following cancellation charges apply based on the date The Company receives written notice:
- More than 30 days prior to installation date: Loss of booking deposit only.
- 15 to 30 days prior to installation date: 50% of the total rental fee is payable.
- Less than 15 days prior to installation date: 100% of the total rental fee is payable.
- The Company reserves the right to terminate the Agreement if the site conditions are deemed unsafe or unsuitable for installation upon arrival.
3. Renter's Responsibilities and Site Requirements
- Site Access: The Renter must provide adequate, clear, and unhindered access to the site for installation and dismantling teams and vehicles.
- Ground Conditions: The site must be level, free from standing water, debris, underground hazards (pipes, cables), and overhead obstructions. Any site preparation (leveling, clearing) is the sole responsibility of the Renter.
- Permissions: The Renter is responsible for obtaining all necessary permits, licenses, and permissions from local authorities (Jaipur/Rajasthan municipal corporations, property owners) required for the erection of temporary structures.
- Utilities: The Renter must clearly mark the location of all underground services (water, gas, electricity) before installation begins. The Renter shall indemnify The Company against any damage to these services.
4. Damage, Loss, and Insurance
- Risk Transfer: Risk of damage, theft, or loss of the Equipment passes to the Renter immediately upon successful installation and remains until The Company completes dismantling and removal.
- Renter Liability: The Renter is fully responsible for the security and care of the Equipment during the entire rental period. Any damage or loss, regardless of cause (including third-party actions, fire, or vandalism), will be charged to the Renter at the full replacement or repair cost.
- Insurance: The Renter is strongly advised to obtain adequate event insurance, including coverage for hired-in equipment, public liability, and cancellation coverage.
5. Use of Equipment
- The Equipment must be used strictly for the purpose for which it was hired (e.g., event venue, exhibition space).
- No alterations, attachments, decorations, or signage may be affixed to the structural components (aluminium framework) without prior written consent from The Company.
- The Renter must ensure that no cooking, open flames, or hazardous materials are used inside or near the structure unless approved in advance and compliant with all local safety regulations.
6. Limitation of Liability and Indemnity
The Company shall not be liable for any indirect, consequential, or economic loss, including loss of profits, arising from the rental or use of the Equipment. Our liability for any claim shall not exceed the total rental fee paid by the Renter. The Renter agrees to indemnify and hold The Company harmless against all claims, demands, liabilities, and costs arising out of the Renter's use of the Equipment or breach of this Agreement.
7. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of India, and the courts located in **Jaipur, Rajasthan** shall have exclusive jurisdiction to resolve any disputes arising under this Agreement.
